GENERAL TERMS OF BUSINESS

1 Scope of Application
The following general terms of business apply for business relations with the customer in the version thereof valid at the time when an order is placed via the internet shop. Customers are both consumers and entrepreneurs. A consumer is defined (§ 13, German Civil Code) as any natural person who enters into a legal transaction for purposes that predominantly are outside of his trade, business or profession. An entrepreneur (§ 14, German Civil Code) is defined as a natural or legal person or a partnership with legal personality who acts, when entering into a legal transaction, for the sake of exercising his commercial or independent professional activity.

2 Closing of Contract
German is the contract language. Presentation of products in the online shop does not constitute a legally binding offer; rather, a non-binding online catalog. You will enter into a binding purchase offer for the products contained in the shopping cart after entering your personal data and clicking on the appropriate button in the final step of the ordering process. You shall have the option, prior to sending the order, to recognize any input errors and to correct and / or change them with the help of the correction function.

Receipt of the order will be confirmed immediately and automatically after it has been sent. Automatic acknowledgment of receipt solely documents that we have received the order and does not represent acceptance of the order. We are entitled to accept your order within 1 working day after receipt by means of sending an order confirmation in writing or in text form (e.g. email). The confirmation will request you to pay and will confirm processing of the order or dispatch of the products. However, the offer shall be deemed rejected after ineffectual expiry of the deadline, and no sales contract will have come about. The following applies for consumers in divergence from the above: the contract shall be closed at the time that you trigger payment if you choose an online payment method or another prepayment method during the ordering process.

3 Payment
Only the payment methods shown in the order process will be accepted. The available methods of payment can be viewed in advance on our website.

4 Delivery
Delivery transpires by means of sending the products to the address stated by the customer. Delivery shall occur against payment of the packing and forwarding costs indicated in the order process, which can be viewed in advance under Customer Information. If an item cannot be delivered, despite careful planning and devoid of any fault, the customer shall be notified via email and any possible payments already made shall be refunded.

5 Retention of Title
The delivered goods shall remain our property until full payment of the purchase price.

6 Warranty
Warranty transpires subject to statutory provisions.

7 Damage in Transit
Please complain about transport damages immediately to the delivery person, and kindly contact us. Contact options may be viewed under Company Information & Disclaimer.

Please note that failure to complain or contact us shall have no legal consequences for your statutory warranty rights. However, such action on your part helps us assert our own claims against the shipping company. The review standard pursuant to § 377 of the German Commercial Code shall apply if you are acting as an entrepreneur.

8 Transfer of Risk
In instances of consumers, risk of accidental loss and accidental deterioration of the sold products shall pass to the consumer, in the event of purchase by shipment of products. when the products are surrendered to the consumer. In instances of entrepreneurs, risk of accidental loss and accidental deterioration of the products shall pass the entrepreneur, in the event of purchase by shipment of products, when the products are delivered to the forwarder, the carrier or the person or institution otherwise responsible for effecting shipment. Surrender shall be equivalent to delivery if the customer is in default with acceptance.

9 Choice of Law and Venue of Courts
All disputes arising from this legal relationship are subject to the law of the Federal Republic of Germany. If the customer is a consumer, the foregoing choice of law applies only insofar as it does not exclude the protection granted by mandatory statutory provisions of the country where the consumer has his habitual residence.
The validity of the UN Sales Convention is excluded. If the customer is an entrepreneur, a legal entity under public law or a special fund under public law, the court district where we have our corporate domicile shall have jurisdiction, provided that an exclusive place of jurisdiction is not established for the dispute.

The EU Commission has created an Internet platform for the online settlement of disputes (so-called "OS platform"). The OS platform serves as a point of contact for out-of-court settlement of disputes arising from online sales contracts.
The OS platform can be reached at the following link: https://ec.europa.eu/consumers/odr. We are not obligated and are not willing to participate in a dispute resolution procedure before a consumer arbitration board.

II. Technical steps that result in closing of contract and correction options: you may place the desired product in the virtual shopping cart without obligation. You can access the shopping cart at any time to correct and/or delete the cart’s content. Please click on "Checkout" if you want to buy the selected products. You will then be asked to enter your personal information, select the payment method and confirm your customer information. You may cancel the order process at any time by closing the browser window, terminating the session or by sending the order. Any input errors made while placing your order can be viewed in the final summary and corrected using the correction functions prior to submitting the order. The contract is closed in accordance with foregoing No. 2 under these same Terms of Business.

III. Please refer to the product descriptions in our online offer for information concerning the main features of the products we offer.

IV. German constitutes the language available for closing of contract.

V. The delivery time may be found in the respective item description. The delivery time shall extend accordingly if delivery falls on a Sunday and on holidays.

VI. Grievances, complaints and other warranty claims can be submitted to the address stated under Company Information & Disclaimer.

VII. The text of the contract shall be saved. You can view our General Terms of Business (GTB) at any time at our website and save them on your computer. The specific order data shall be sent to you via email and may be viewed in the Login area when you log on.
